The United States officially launched a survey on China's new energy industry

Following the announcement of the 301 investigation of China's green technology trading and investment policy, on October 20, local time, the US Trade Representative Office notified that it officially began to investigate as part of the 301 investigation.

According to the content of the paper, within 90 days, the office will seek information and advice from the complainant, the advisory committee and other relevant interest groups to investigate the relevant laws, policies and practices affecting green technology transactions and investments in China, and then trade representatives. Based on these information and recommendations, we will work with other US government agencies to verify the appeal file. Since the investigation was officially announced on the 20th, the current office has not received any request for a hearing.

It is too early to say the trade war
The 301 investigation pushed Sino-US relations to a very sensitive level. To this end, the "First Financial Daily" reporter specifically contacted the Office of the US Trade Representative. The office spokesperson Nefeterius Akeli McPherson told this reporter: "If there is reason to not negotiate one or more assertions, then it is not legally feasible."

Stephen Kho, a senior attorney at Akin Gump Strauss Hauer & Feld, was the deputy general counsel of the US Trade Representative Office and the executive chief lawyer of the Chinese Law Enforcement Department. He told reporters that the frank dialogue between the two sides is very important, especially China must provide facts to prove that the allegations are untenable.

"China should openly talk to the United States." Xu Siyi said, "I don't think this means a trade war. Any one side is overreacting. This (trade war) can happen. I hope people understand that the trade relationship between the two countries is very important."

Kenneth G. Lieberthal, director of the Brookings Think Tank John Thornton China Center, believes that this is only a routine government practice and has nothing to do with the midterm elections.
“The US Steel Workers’ Federation filed a complaint a few weeks ago, not from the Obama administration’s proposal.” Li said, “US law requires the US government to respond to such formal complaints.”

However, some experts believe that 301 complaints from institutions or groups are rarely accepted by the US Trade Representative Office. The Trade Representative Office accepted the complaint and the political environment was a very important reason. The complaint was supported by many Members. In addition, the complaint raises five major questions, which is almost unprecedented. The general complaint only focuses on one or two issues. This also makes the government have to investigate which is the truth.

Mike Fossen also told reporters: "Considering the number and variety of allegations and the large number of documents included in the complaint, the Office of the US Trade Representative believes that the use of this clause (delayed 90 days to negotiate with another country to use this to investigate) is appropriate. ”

Potentially affecting China's economic development
At present, experts are afraid to draw conclusions on the investigation. However, Xu Siyi believes that if the Chinese and US governments subsidize and support green technology companies, then there will be no problems.

In fact, the United Steelworkers Federation has a long history of "ghosts" in China. The federation filed a 301 lawsuit against the Chinese currency issue a few years ago, but was rejected by the US government. On its website, there are quite a few news related to China. In the past two months, there have been such things as "the Iron and Steel Workers Federation upheld the US International Trade Commission to vote for China to import seamless steel pipe tariffs", "the US Congress wrote to Obama to support the Steel Workers Union to China 301 complaints", "the US House of Representatives The vote for China's currency reform has been strongly endorsed by the Steel Workers' Federation.

The U.S. Steel Workers’ Federation’s allegations against China are related to the WTO provisions. Experts believe that this is mainly because the federation wants to push the event to the height of international influence. If the US government upgrades this matter to the WTO level, then the WTO's ruling on the whole matter may be dragged on for several years. Even if the final ruling proves that China is not wrong, the whole process is very unfavorable to the development of China's related fields.

“Once entering the international process, this issue will be widely known,” Xu said. “There may be economic consequences, which will affect the development of the (green energy) technology industry.”
